Dog owner contemplates criminal charge after vicious dog bite

When many people in the Bronx think about premises liability, they think about slip-and-fall accidents or becoming injured in a store, restaurant or other public location. When someone is injured inside another person’s home or on his or her property, however, it is also considered premises liability and the homeowner can be sued for compensation. One of the most common types of injuries in the home is a dog bite.

Though this dog attack did not happen in the Bronx, it is unique in that the dog’s owner has been presented with a plea deal that would require him to put his dog down. The 28-year-old man is not only facing a premises liability lawsuit filed by the individuals who were bit by his dog, but he is also dealing with serious criminal charges. It is for these criminal charges that he is being asked to put his pit bull down.

The 6-year-old dog allegedly attacked another man at his owner’s home. His owner and the man who was bit had been fighting, though both men have different stories as to why they were quarreling. The dog owner’s lawyer has said that the dog was merely defending its owner, which, under state law, means the dog cannot be considered dangerous.

Even if the dog is not legally classified as dangerous and the dog is not put down, it should not prevent the man who was attacked from collecting in his premises liability lawsuit. No one should face serious injuries just for visiting someone’s home and, when they do, they should be able to hold the homeowner financially liable. By working with an experienced New York premises liability lawyer, the wounded victim can file a lawsuit, asking for his or her medical bills and lost wages to be covered. In some instances, punitive damages may also be awarded.
